HE FOLLOWS THE CONSTITUTION? IN YOUR DREAMS!

President BO (the child president)'s interview on Public Radio station WBEZ-FM in 2001:

"If you look at the victories and failures of the civil rights movement and its litigation strategy in the court. I think where it succeeded was to invest formal rights in previously dispossessed people, so that now I would have the right to vote. I would now be able to sit at the lunch counter and order as long as I could pay for it I’d be o.k. But, the Supreme Court never ventured into the issues of redistribution of wealth, and of more basic issues such as political and economic justice in society.

To that extent, as radical as I think people try to characterize the Warren Court, it wasn’t that radical. It didn’t break free from the essential constraints that were placed by the founding fathers in the Constitution, at least as its been interpreted and Warren Court interpreted in the same way, that generally the Constitution is a charter of negative liberties. Says what the states can’t do to you. Says what the Federal government can’t do to you, but doesn’t say what the Federal government or State government must do on your behalf, and that hasn’t shifted and one of the, I think, tragedies of the civil rights movement was, um, because the civil rights movement became so court focused I think there was a tendency to lose track of the political and community organizing and activities on the ground that are able to put together the actual coalition of powers through which you bring about redistributive change. In some ways we still suffer from that."

Following the Deepwater Horizon oil spill, the Interior Department issued a blanket six-month moratorium on new oil and gas drilling in the Gulf of Mexico. A federal judge struck down that moratorium as arbitrary and capricious. The judge was so shocked by the administration’s conduct that he found the government in civil contempt of court.

The Obama administration bullied Chrysler’s secured creditors — who were entitled to “absolute priority” — into accepting 30 cents on the dollar. This is government-directed industrial policy to help political insiders — discourages investors and generally undermines confidence in American rule of law.

Then there's this in ObamaCare: The Independent Payment Advisory Board (a.k.a. “The Death Panel”); Medicaid coercion; The Individual Mandate and Health care waivers.

2011

The FDA issued regulations requiring cigarette manufacturers to display graphic warnings on all packs of cigarettes that must cover at least 50% of the packaging and graphically portray tobacco-related illnesses. These warnings violate the First Amendment because the government is compelling the cigarette manufacturers to discourage their customers from buying their lawful products. Last month, a federal judge blocked the new regulation, which was due to go into effect in January, but the administration is appealing.

2012

The Treasury Department now has broad and essentially unchecked power to seize banks and other financial entities that it determines are unsound but “too big to fail.” The new Consumer Financial Protection Bureau and Financial Stability Oversight Council, meanwhile, craft, execute and interpret their own law.

In April of this year, President BO (the child president) released a draft executive order that would require businesses with federal contracts to disclose independent expenditures on federal elections (political speech independent of candidates and parties). This order is intended to undermine the Supreme Court’s Citizen United decision by discouraging federal contractors and their executives from engaging in political speech.
Earlier this year, the IRS tried to muzzle political speech by asserting that donations to certain nonprofit advocacy groups (so-called 501(c)(4) organizations) would be subject to the gift tax. It was trying to chill the political speech of those opposed to President BO (the child president)’s policies, in violation of the First Amendment.

Feb. 21, 2012:

President BO (the child president) said The U.S. Constitution is out-of-date, so he is ripping it up and writing a new one.

President BO (the child president) told reporters that the U.S. Constitution has become a hindrance to progress in America. “The document is so out-dated, that it is now becoming a hindrance to governing the country.”

Obama said that he has signed an Executive Order voiding the U.S. Constitution. “We need to move forward. We need change.”

Obama said he has already drafted a new constitution and that Americans “will love what I came up with.” Insiders say that Obama is keeping a lot of old elements from the original constitution “he’s just making it better, bringing it into the 21st century,”

OK. That last one is questionable, but you get the drift.

President BO (the child president) does not care about, does not follow, does not preserve, does not protect and does not defend the Constitution of the United States of America.

Oh Joe - When you find yourself in a hole, stop digging.

Not a single one of the stories you told violated the Constitution in any way. It was just a bunch of stuff you disagree with.

When the Supreme Court rules that an action taken by the president is unconstitutional, then and ONLY then can you say he has violated the Constitution.

Until then, all of your whining is just sour grapes from a group of people who want to drag the country back into the stone age rather than see us ALL progress and move forward as a modern, civilized nation.

Everything about Mitt Romney is fake....the more I see of him the sicker I become. There's not an ounce of patriotism in Mitt Romney, he's a fraud. He is a coward, a liar, a fake and a fraud....Go ahead wingnuts, vote for this pitiful excuse for an American. But PLEASE tell us, in plain English, WHY you are voting for him, , WHAT will he do different, HOW will he grow the middle class, WHEN will those tax breaks to his cronies FINALLY kick in, and WHEN will the hiring begin?? You believe as soon as the black man is out of the White House all goodness and prosperity will spring forth? Millions of jobs will suddenly appear?

The rich will get richer and the poor will get poorer? OH Yea, that's it!! If the rich are doing so well why do they need governments help? Hmmm, that's something I can't quite figure out...Conservatives want the poor and helpless to get off their lazy asses and find work, stop being moochers, yet they never say that to the rich who have their hands out accepting government subsidies....

How dare the haters talk dirt on Barack Obama who has worked his whole adult life helping those less fortunate, how un-Christian of him! But show them a fake patriot, a draft dodger who encouraged others to enlist while he made excuses, a man who found joy in making millions while watching thousands lose their jobs.... oh you better believe he found joy in that!

What a first class scum bag, Republicans poster boy...Willard Mittens Romney

Assuming the judge wasn't on the take from Mary Landrieux (D - Oil and gas pimp) the system seems to have worked just fine.

I'm surprised you Constitution boys aren't embarrassed when you trot out this ridiculous argument.

Doesn't Jo Joe have some hard and fast rule about staying on topic in the comment section?

If it were up to me, I would just admonish you gently. But in keeping with the extreme views of of the readership of this blog, I suspect the actual verdict handed down will be "BURN HER!!! BURN HER!!!"

It's sort of a "death to all fanatics" approach to civilized discourse.

XO: "When the Supreme Court rules that an action taken by the president is unconstitutional, then and ONLY then can you say he has violated the Constitution."

Nonsense!

I can read. I know what the Constitution says. I can apply its principles without much effort.

The trouble with you liberals is that you can't read, don't understand and can't understand principles (since you don't have any).

Ducky's here said...

Here comes the "you can't read" and you are immoral ad hominems.

Proof you've been backed into the corner again.

Lisa said...

XO I was responding to the off topic anon #4 comment

Joe said...

Ducky: No corner. The Constitution just is not that hard to read. It says what it says and it needs no spin or tilt.

It's like the sentence: "Take the car and go to the store."

No normal human being would "misinterpret" that.

Some liberal might say it implies that stealing cars is OK and that the store referred to someplace where the drugs are kept. That, however, would not be the case with normal people.

So it is with the Constitution. There is face value and there is spin.

Liberals spin. That is why they remain so dizzy and confused.

The more you spin the more you have to remember what you spun and how you spun it, lest you seem to contradict youself. Which no liberal ever does, of course.

Xavier Onassis said...

Joe - My point is (because conservatives need to have even the most obvious points explained to them) that it's not your call.

You can read and interpret the Constitution to your heart's content. Form whatever opinions you like. It's a free country.

But determining whether the actions of the Executive or Legislative branches of government are Constitutional or not is the sole provence of the United States Supreme Court. Period.

Your opinion means nothing. Except in the voting booth.

Joe said...

XO: Taking a page from the liberal handbook, I plan to vote early and vote often.

Xavier Onassis said...

Joe - You can take comfort in the fact that every one of your votes will be cancelled out by every one of my votes.

Sadly for you and yours, there are WAY more people in this country who agree with me than agree with you.

Obama will win a 2nd term by a landslide. No contest.

Joe said...

XO: "...there are WAY more people in this country who agree with me than agree with you."

This is becoming clear Joe.

If you dislike a policy it is unconstitutional. If the appellate courts or any other level do not issue any ruling and you still disagree, the policy is unconstitutional.
If Scotus rules that a bill is constitutional but you disagree, the bill is unconstitutional.

In order for the congress to be square with the constitution it has to agree with Joe (or the Lone Ranger).

This is easy.

Power always follows property. This I believe to be as infallible a maxim in politics, as that action and reaction are equal is in mechanics. Nay, I believe we may advance one step farther, and affirm that the balance of power in a society accompanies the balance of property in land. The only possible way, then, of preserving the balance of power on the side of equal liberty and public virtue is to make the acquisition of land easy to every member of society; to make a division of the land into small quantities, so that the multitude may be possessed of landed estates. If the multitude is possessed of the balance of real estate, the multitude will have the balance of power, and in that case the multitude will take care of the liberty, virtue, and interest of the multitude in all acts of government.

"The Remissness of our People in Paying Taxes is highly blameable; the Unwillingness to pay them is still more so. I see, in some Resolutions of Town Meetings, a Remonstrance against giving Congress a Power to take, as they call it, the People's Money out of their Pockets, tho' only to pay the Interest and Principal of Debts duly contracted. They seem to mistake the Point. Money, justly due from the People, is their Creditors' Money, and no longer the Money of the People, who, if they withhold it, should be compelled to pay by some Law.

All Property, indeed, except the Savage's temporary Cabin, his Bow, his Matchcoat, and other little Acquisitions, absolutely necessary for his Subsistence, seems to me to be the Creature of public Convention. Hence the Public has the Right of Regulating Descents, and all other Conveyances of Property, and even of limiting the Quantity and the Uses of it. All the Property that is necessary to a Man, for the Conservation of the Individual and the Propagation of the Species, is his natural Right, which none can justly deprive him of: But all Property superfluous to such purposes is the Property of the Publick, who, by their Laws, have created it, and who may therefore by other Laws dispose of it, whenever the Welfare of the Publick shall demand such Disposition. He that does not like civil Society on these Terms, let him retire and live among Savages. He can have no right to the benefits of Society, who will not pay his Club towards the Support of it."

My opinion on Obamacare..
Now let me get this straight and please correct me if I’m wrong. . . ..
We're going to be "gifted" with a health care plan we are forced to purchase and
fined if we don't!
Which, purportedly covers at least ten million more people, without adding a single new doctor, but provides for 16,000 new IRS agents,
written by a committee whose chairman says he doesn't understand it,
passed by a Congress that didn't read it and told us to vote for it so that we could read it,(and then went ahead and exempted themselves from it),
and signed by a Dumbo President who smokes, with funding administered by a treasury chief who didn't pay his taxes, for which we'll be taxed for four years before any
benefits take effect, by a congress which has
already bankrupted Social Security and Medicare, all to be overseen by an obese surgeon general and financed by a country that's broke!!

What the hell could possibly go wrong?

Craig said...

Okay. It's 30M, not 10M. 16,000 IRS agents is a lie. If Congress didn't read it, it's because they were lazy. It was debated for a year and posted online. The Treasury doesn't oversee funding and Social Security and Medicare are not bankrupt.

Funny you would choose a megalomaniacal blowhard to quote. Without attribution, BTW.

Do you also disbelieve the stories about Rev. Wright, Bill Ayers, Van Jones, etc.etc. etc. are also concocted stories? Do you feel that all these are "inconsequential and of no importance" and that anything this President says is fact? People like you defend him. No Matter What! Well I don’t and I won’t, I don’t trust this man and never will. How about that Open mic issue with the Russian, I suppose that was no big deal either! And I bet that you believe that Obama - never heard Rev Wright say anything like that before during his 20 years at his church either! Am I getting close? Bill Ayers was his friend, no big deal? Ok, I get it, you’re a “It's Bush's fault” person, a bleeding heart Liberal, who believes that the Muslims has a good reason to crash those planes into the WTC because of America’s arrogance.
The damage he has caused our country is a “fait accompli”. I hope he fails at every thing that he tries to do to this country. He is a narcissistic liar who intends to destroy our country
Ok, you can start defending and calling me names in 1....2....3 seconds. You can start by calling me a “Racist”. I really don’t give a Rat’s behind!

I do agree with you and Maggie, Obama hasn't been properly vetted. I think Romney should make the birth cert., Rev. Wright, Ayers and college transcripts the center piece of his campaign. His cred as a job creator at Bain is shot. This vetting stuff is golden, it'll work this time for sure.

For Ryan to claim his budget reflects Catholic values and principals, seems a stretch. At least to the people who should know.

His credentials as a good, decent Catholic are about as convincing as his cred as a deficit hawk. He voted FOR 2 unfunded wars, Tarp, the auto bailout, tax cuts for the wealthy, Medicare part D and Bush's $192B stimulus. Under the Ryan budget, Romney's tax burden on the only return he has made public would have been less than 1% of his income. Your tax burden would go up about $2,000.
