The 10th Amendment says: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
I have read this amendment hundreds of times looking for some ambiguity in it. There is none.
It is important to note that the Tenth Amendment was not part of the body of the Constitution, but was added to ensure that the power of the federal government did not impose on the rights of the citizens, under the theory that "the closer to home one gets, the more power over their own affairs they should have."
It was based on this from the Articles of Confederation: "Each state retains its sovereignty, freedom, and independence, and every power, jurisdiction, and right, which is not by this Confederation expressly delegated to the United States, in Congress assembled."
The Tenth Amendment was designed, as were all of the amendments, to change something, to add something or to clarify something in the body of the Constitution. A simple explanation of it can be found HERE.
Over the years, Congress, in their ever-growing thirst for control, have used Article 1, Section 8, Clause 3 of the United States Constitution SEEN HERE, known as the Commerce Clause, which states that Congress has the power to regulate commerce with foreign nations, among the states, and with the Indian tribes, to overcome the restrictions of the Tenth Amendment.
In each case, Congress was wrong to have done so, Supreme Court rulings otherwise notwithstanding.
(Note: The Supreme Court has been wrong on several occasions and its decisions have been subsequently reversed. Two examples of rulings that need to be revisited are: the Supreme Court upheld the Fair Labor Standards Act which regulated the production of goods shipped across state lines [1941] and Wickard v. Filburn, [1942] in which the Court upheld the Agricultural Adjustment Act, which sought to stabilize wide fluctuations in the market price for wheat by stabilizing supply through quotas. Others include: public housing, gun control, voter registration, education, and marriage)
The end result of power grasped by the federal government as they circumvent the Tenth Amendment, is legislation on a myriad of things that should NEVER have become federal issues.
My previous post (ANOTHER BITE OUT OF FREEDOM) is an example.
So is the health care legislation recently signed into law.
The overriding issue is the lack of respect for the original document that is the Constitution of the United States of America.
Although members of Congress and President BO swore an oath to defend and protect it, they clearly do not agree with it, nor do they respect it as a rule book for the federal government.
"Oh, Joe, you're so reactionary! Nobody in Congress has disdain for the Constitution! They all respect and care about it!"
Oh, yeah?
Check this out (h/t to Gateway Pundit):
So look, don't try to talk to me about Congress' respect for the Constitution.
In their minds, they control the Constitution and it says what they say it says, not what it actually says.
They don't care about it, liberals don't care about it and if they say they do, watch out for them...they'll lie to you about other things, too.
Apology: Sorry about the deletions. I thought I was deleting one comment and they all disappeared! Argh!!! I don't even know how to do a mass deletion...but I guess I do now, only I can't remember what I did.

It's always about the children with them. What ever happened to SCHIP?
These people think it's so important why do they have to wait 4 years? They are so generous with other people's money.
I had to post on this video. Thanks for pointing it out.
I can't believe how stupid he believes his constituent are.
This is a clear reason for us to pay better attention to who we put in office.
lisa: They've spent ALL of mine.
ablur: I guess his constituents either don't know what he thinks, don't care what he thinks or agree with what he thinks.
Joe, I don't think those who voted him in don't care about much of anything...They voted him in....The DEmies like him though, they can lead him around and he will vote, just tell me when and what......stay well....
I'd love to see those comments that were deleted...oh well...
Joe, this is SO right. They don't care about the Constitution. They don't care about the foundation of our country, or what it took to defend & protect it so they have the freedom to rip it to shreds. God have mercy on us...we've been sons & daughters of freedom for so long that we don't have any concept of what we're bringing upon ourselves...
Heaven help us.
It's always about the children. Yep. Gotta protect the children ... but the PARENTS can drop dead.
I'm an uninsured American because my state doesn't allow me to accept insurance from a company which excluded a pre-existing condition (knees - had surgery on both and was told I had to wait two years for coverage ... then some 17-yr-old read ended me right before my two years was up and I suffered a head injury). I don't want this man or any other person to make laws regarding MY healthcare! It was a law written by a man like this that prevented me from getting coverage in the first place! Dillholes ... all of them!
Tapline: He couldn't care less what the people he is supposed to serve want.
Susannah: So would I. They disappeared before I got to read them. The surprise is just around the corner.
Krystal: "Dillholes" is much too kind.
Great post, Joe.
Linked at Bread upon the Waters.
I commented earlier that I think this guy's where we got the expression "HARE brained".
He admits not caring about the constitution, gets worried about how that's going to play, then the interviewer falls RIGHT into his hands with "you're a liar"...so, the ever-so self-righteous Hare jumps out of his chair outraged at THAT comment more than HIS...and expecting us to follow suit; Typical leftist behavior. He must have worked at one time for the media.
Here's a great article someone posted on a blog from American Thinker by John Grifiing. A little long but quite profound.

I'm just praying people around me here in Illinois are waking up. I'm only one vote!
Joe, "dillholes" may be too kind, but it's the some of the strongest language I use. :)
