New GM said not responsible to fix Impala made by old GM

NEW YORK, Aug 19 (Reuters) - General Motors Co (GM.N) is seeking to dismiss a lawsuit over a suspension problem on more than 400,000 Chevrolet Impalas from the 2007 and 2008 model years, saying it should not be responsible for repairs because the flaw predated its bankruptcy.

The lawsuit, filed on June 29 by Donna Trusky of Blakely, Pennsylvania, contended that her Impala suffered from faulty rear spindle rods, causing her rear tires to wear out after just 6,000 miles. [ID:nN1E7650CT]

Seeking class-action status and alleging breach of warranty, the lawsuit demands that GM fix the rods, saying that it had done so on Impala police vehicles.

But in a recent filing with the U.S. District Court in Detroit, GM noted that the cars were made by its predecessor General Motors Corp, now called Motors Liquidation Co or "Old GM," before its 2009 bankruptcy and federal bailout.

The current company, called "New GM," said it did not assume responsibility under the reorganization to fix the Impala problem, but only to make repairs "subject to conditions and limitations" in express written warranties. In essence, the automaker said, Trusky sued the wrong entity.

"New GM's warranty obligations for vehicles sold by Old GM are limited to the express terms and conditions in the Old GM written warranties on a going-forward basis," wrote Benjamin Jeffers, a lawyer for GM. "New GM did not assume responsibility for Old GM's design choices..."

The One tells another big one.

sue: I love WAM and LvB.

My favorite pieces of all time include LvB's 5th & 9th and PIC's 6th (Pathetique).

I also like anything JSB that does not sound like a finger exercise.

IS's "Rite of Spring" facinates me.

My favorite conductors were Leonard Bernstein and Arturo Toscanini.

And my favorite singers of Christian music are (is) the Mormon Tabernacle Choir.

Joe, Joe - If you think Bach sounds like a finger exercise, then you need to learn to play the piano - and experience his music for yourself.

Or go out and buy the Goldberg Variations performed by Glenn Gould.

Bach is music in it's purest form.

I rarely enjoy listening to Bach, but when I play it myself (and I'm not that good), it is a very complete and satifying experience.


Finger exercise, indeed.

Contrary to what many may think, Bach was a passionate man. After all, he had 20 (or was it 21) children, and went through two wives.

P.S. I'm not sure how really submissive they were.

Boy, JOe! I'm not sure your and my music tastes could be more different (tho I kind of like the Mormon Tabernacle Choir) :-)

I'm sorry nobody addressed the tire problem in your post...that is AMAZING. Does this "new" and "old" GM protestation mean more than we think?.......DO we own them now? ARE they an entirely different entity under the gov't because of the loans in some technical way we aren't hearing?
Sounds NUTS, but........geeeeZ, worth a thought!?

Z: GM IS a different entity. It is truly Government Motors. Step one in the government take-over of business in America.

sue: Some of Bach's work DOES sound like and play like finger exercises. On the other hand, some of it is magnificent!

About Bach - Although any Bach that I attempt to play to me is magnificant, there have been times when I've thought, JS, maybe it's just too late at night and one of your childern are crying. Give it up and try again in the morning!

It's either that or my mind does not operate on the same level as his - probably the latter.

Z: My musical tastes are actually quite eccletic.

I also loved the Beatles (pre-Yellow Submarine); The Kingston Trio; Louis Armstrong; Dave Brubeck; George Shearing; Lionel Hampton; Ertha Kitt; Prince (or whoever he is nowadays); Arthur Godfrey; KISS; a little alternative and an occasional Emenem...but not too much.

I just love music...all kinds except opera and acid.
